TENDER OF A
DEPOSIT BY A PASSENGER OR THEIR AGENT
CONSTITUTES ACCEPTANCE OF THE FOLLOWING:
Tropical Travel and Mexico Colonial Cities
act only as agent for the owners and operators of the various
accommodations, facilities, services and transportation, and their
responsibility is limited to that of an agent. In the absence of
negligence, Tour Participant agrees not to hold any of the aforementioned
parties liable, and they hereby disclaims all liability for the delay,
loss, injury, expense or accident occasioned directly or indirectly by any
action or omission, whether negligent or otherwise, of any Supplier or
other entity entrusted with the performance of any service or the delivery
of any goods in connection with this tour or any available option. Tour
Participant agrees to seek all remedies directly from the Suppliers.
RATES
The prices in this website are based
on rates and costs in effect at time of posting. Packages and prices are
valid through at least October 1, 2014. Prices are subject to change
without notice. We reserve the right to alter prices at any time prior to
your deposit. All rates are in U.S. dollars. Rates are per person, based
on double occupancy, unless otherwise specified.
DEPOSITS
A non-refundable deposit of
30% per person is required within 7 days of booking to secure any
reservation. Final payment is due no later than 45 (60*) days prior to departure. Bookings made 45 or less days prior to departure require payment in full. Bookings or changes within 14 days of departure are subject to a $100 charge to cover long distance calls and other expenses. Certain tours, especially customized group tours, may have deposit amounts and conditions different than these generalities.
FINAL
PAYMENTS
Final payment is due 45 (60*) days in
advance of the tour. If reservations are made less than 45 days prior to
departure, payment in full is required at the time of booking. If final
payments are not received on time, Tropical Travel and Mexico Colonial
Cities may cancel the reservation and invoke the cancellation fee.
CHANGES
A $50 per transaction
fee will be charged for any alteration or revision made to a confirmed
reservation prior to the issuance of travel documents. Once travel
documents and tickets have been issued a $100 per person change fee applies. Changes by Passengers are also subject to any other change or cancellation penalties that may be imposed by suppliers or the airlines.
CANCELLATION
PENALTIES AND REFUNDS
All
requests must be in writing and sent by U.S. Mail, otherwise no refunds can be
made. Any valid cancellation refunds will be remitted within 30 days after the
cancellation notice is received, unless the amount of the refund is contingent
upon further advice from an airline, hotel or other Supplier. If the
cancellation request is received prior to 60 days from departure there will be a
penalty of $200 ($400*) per person charge will be assessed in addition to any
other cancellation fees and other charges which may be assessed by Suppliers.
For cancellations requested 59 to 45 days before departure date the tour deposit
will be forfeited, Cancellation requests received less than 45, but more than 31
days prior to departure will be assessed 50% of the tour cost, plus other
assessed charges. Cancellations 30 days or less or “no-shows” will not receive
any refund.
All
requests for a refund after a trip must be made in writing within 30 days after
completion of travel, otherwise no refund will be made. All appropriate receipts
and documentation must accompany the refund request. No refund will be made for
features the participant opts not to use. Refunds will be mailed within 30 days
of receipt of request unless the amount of the refund is contingent upon further
advice from airline, hotel or other supplier. Once travel commences, unused
portions of packages are non-refundable. Once travel begins, any changes made by
a participant are the responsibility of the participant and any refund for
unused features is subject to prior reimbursement by the Supplier to Tropical
Travel Representatives/Mexico Colonial Cities.
The above
Cancellation Penalties, while well within industry Superiors, are significant.
For this reason we strongly urge you to purchase Travel Insurance, including
Trip Cancellation Coverage, a Superior benefit offered with most Travel
Insurance Comprehensive Plans. Most Travel Insurance benefits include
reimbursement of all your pre-paid, non-refundable expenses should you need to
cancel your trip unexpectedly. Please be aware, however, that all Trip
Cancellation insurances do not cover every reason for cancellation. You are
solely responsible for obtaining such insurance and for understanding the scope
of coverage, if any. A source for coverage is presented above.

Earlier payment due dates and/or higher penalties or fees apply to major holiday
periods, i.e. Thanksgiving, Christmas and New Years, Holy Week, Spring Break,
etc., customized tours and to tour utilizing suppliers of unique services.
Travel
agent fees, if applicable, may also apply.
PARTICIPATION
It is your responsibility to select a trip that is appropriate to your health, physical abilities and interests. As important is a positive mental attitude, a willingness to try new and different experiences and a sense of humor. We want each of you to enjoy and learn from each of our tours. We are happy to discuss our offerings with you and answer any
question that you might have.
ENTRY AND EXIT REQUIREMENTS
As of January 2007 all U.S. citizens are required to have a valid U.S. passport for entry by air into the United States. Each other country has its own entry/exit requirements. It is your responsibility
to make sure that you have and carry with you the necessary documentation. Also,
each country has its own exit/departure fees. Those stated by us will be
accurate at the time of discussion, but changes in the fees and shifting currency
values might cause these fees to change. Please be mindful that we have no
control over these changes.
INTERRUPTIONS OR CANCELLATIONS
Certain services may be interrupted or
cancelled due to weather or other conditions out of the control of
Suppliers, Tropical Travel or Mexico Colonial Cities. No refunds will be
granted as a result of any such interruptions or cancellations.
AIRLINE TICKETS
Air tickets, if any, are issued on a special promotion fare. Certain restrictions, including (but not limited to) the fact that lost tickets are non-refundable,
and that they are subject to individual airline restrictions, penalties
and fees apply. Airfares are subject to availability and are subject change without
notice until the tickets have been issued.
Flight numbers and schedules
are subject to change until the date of travel.
TRAVEL INSURANCE
Important
- Please Note:
Anytime, anywhere unexpected events can
complicate even the best planned trip. We have made every reasonable
effort to make this tour as enjoyable and worry free as possible. But, it
must be remembered that this tour takes you to out of the way places to
experience different and unique activities. Cancellations, delays,
accidents and other problems can and do arise. Any of these could affect
your schedule, health, property and trip deposits or payments. While we,
acting only as agents and sponsor, cannot be held responsible, if problems
do arise we do not want to have you inconvenienced or penalized for
problems. Your upcoming trip is a significant investment which you should
protect. It is your responsibility to ensure that you take out a
comprehensive travel insurance policy to cover you during your travel. If
you choose to travel without adequate travel insurance cover, we will not
be liable for any losses howsoever arising, in respect of which insurance
cover would otherwise have been available.

PASSPORTS, VISAS AND HEALTH
REQUIREMENTS
It is your responsibility
to fulfill the passport, visa and other immigration requirements
applicable to your itinerary. We can provide general information about the
passport and visa requirements for your trip. Your specific passport and
visa requirements and other immigration requirements for you and your
party are your responsibility and you should confirm these with the
relevant Embassies and/or Consulates. We can provide general information
about any health formalities required for your trip but you should check
with your own doctor for your own specific circumstances. We do not accept
any responsibility if you cannot travel, or incur any other loss because
you have not complied with any passport, visa, immigration requirements or
health formalities. You agree to indemnify us in relation to any costs
which we incur as a result of your failure to comply with any passport,
visa, immigration requirements or health formalities. Most countries now
require passports to be valid for at least 6 months after your return
date. If your passport is in its final year, you should check with the
Embassy of the country you are visiting. It is your responsibility to
check visa requirements for your destination.
TOUR START
DATE
The Tour Start Date is
the first date on the itinerary that you have reserved with
Tropical Travel and Mexico Colonial Cities.
It does not include any earlier departure date that you may have planned
including, but not limited, to airline flights arranged for and necessary
to your embarkation on the Tour Start Date. It is your responsibility to
be ready to embark on the tour as specified in the itinerary.
Tropical Travel and Mexico Colonial Cities
is not responsible for any losses due to cancelled or missed flights,
changed flight itineraries, late arrivals, or early departures.
TRAVEL
DELAYS
We
will base your itinerary on the reliable services of major international
airlines. These airlines are rarely subject to lengthy delays, but there
are occasions when delays do occur. While we will make reasonable efforts
to minimize any delays or amendments to your itinerary we cannot accept
responsibility for such events and do not provide for arrangements for
meals, overnight accommodation or any other cost resulting from delay. If
you face a delay or are denied boarding we advise you to first contact
your airline, who may be able to assist.
MEDICAL
FITNESS AND AGE
Good physical and mental health is essential for the
enjoyment of the active outdoor tours arranged by
Tropical Travel and Mexico Colonial Cities.
By tendering a deposit and/or making a final payment for a tour the client
certifies that he/she does not have any physical or other condition of
disability that would create a hazard for him/herself or other clients,
trip leaders or company representatives. It is essential that any
participant with a medical condition that may be affected by motion on a
body of water, vigorous activity, high altitude, headache, cold, other
natural phenomenon, or particular foods or allergic reactions, notify
Tropical Travel and Mexico Colonial Cities
in writing in advance of travel.
Tropical Travel and Mexico Colonial Cities
expressly disclaims any and all liability for medical care or for special
dietary requirements.
MEDICAL
INSURANCE
It is the client’s responsibility to obtain
personal travel-related medical insurance. Often, your personal medical
insurance may not cover you for medical services, whether basic, urgent,
emergency, catastrophic, or otherwise, while you are traveling. It is your
responsibility to determine if your existing medical coverage is adequate
for the duration of your tour. It is also your responsibility to have or
to obtain sufficient coverage for any medical services you might require,
including up to catastrophic, long-term medical services coverage. This
insurance must cover personal accident, medical expenses, air ambulance,
loss of effects, repatriation costs and all other expenses which might
arise as a result of loss, damage, injury, delay or inconvenience
occurring to the client.
FORCE
MAJEURE
Tropical Travel and Mexico
Colonial Cities
will not be
deemed in breach of this agreement or otherwise liable to you, by reason
of delay in performance or nonperformance of any of its obligations under
this agreement to the extent that any such delay or nonperformance is due
to any force majeure. “Force Majeure” means any circumstances
beyond the reasonable control of
Tropical Travel and Mexico
Colonial Cities
including,
without limitation, acts of God, terrorist activities, insurrection,
explosion, flood, tempest, forceful wind, fire or accident, war or threat
of war declared or undeclared, sabotage, civil disturbance, labor strikes,
requisition, sickness, quarantine, government intervention, weather
conditions, and unforeseen circumstances. If
Tropical Travel and Mexico
Colonial Cities
and/or any of its third party suppliers are affected by Force Majeure,
they shall be entitled to, and may in their sole discretion, vary or
cancel any itinerary or arrangement in relation to the tour.
